ELIGIBILITY: The
GiveawayADay.com Daily Sweepstakes (the “Sweepstakes”)
begin at 12:01 PM Central Time (CT) and end at 11:59
AM CT each day (a “Day” is any 24-hour
period, starting at 12:01 PM to 11:59 AM, Central
Time) beginning on April 23, 2008 through May 20,
2008 (the “Promotion Period”). The Sweepstakes
are open to all legal residents of the United States,
its territories and Canada (except for the province
of Quebec). You must be 18 years of age or older.
Employees, officers, and directors of Web Rodeo,
Inc. (“Sponsor” or “We”)
and its affiliated companies, subsidiaries, distributors,
dealers, advertising and promotion agencies, any
and all other entities directly associated with this
Sweepstakes, as well as the immediate family members
and members of the same household of any of the above
are not eligible to participate.
HOW TO ENTER: (1) Visit Sponsor’s
www.GiveawayADay.com website (the “Website”)
and complete the registration form provided, submit
it, and you will be automatically entered into that
Day’s Sweepstakes. For subsequent daily Sweepstakes,
login to the Website and enter into that Day’s
daily Sweepstakes. To be eligible to win, members
must remain in good standing throughout the duration
of the Sweepstakes. Entrants may not register for
the Sweepstakes or submit entries to the Sweepstakes
via multiple email addresses or multiple identities.
Any entrants that register using an email address
that is invalid, mis-directed illegible, or is otherwise
undeliverable, or not received due to technical malfunction,
will not be eligible. Any entrant who attempts to
register for the Sweepstakes or submit entries to
the Sweepstakes via any of the aforementioned means
will be disqualified. Entrants may not submit additional
entries to the Sweepstakes, except for as expressly
permitted by these Official Rules. (2) Handprint
on a 3”x 5” card, your full name, date
of birth, address (including zip code), day & evening
phone numbers with area code, gender, email address
(if you have one), and mail in a first class stamped
envelope (no metered mail accepted) to:

Mailed entries will be entered into the daily Sweepstakes
on the Day the entry is physically received, provided
that such entries are received by May 20, 2008. All
entries become the property of the Sponsor once they
are received by the Sponsor. For each entry you send
to the Sponsor, you will be entered once into that
Day’s Sweepstakes. Each entry must be mailed
separately. Except for as provided herein, the limit
is one (1) entry per person per Day.
ADDITIONAL ENTRIES: Each member has
the opportunity to earn additional entries in the following
ways:
(i) a member receives three (3) additional entries every time he or she sets their homepage to the website designated by the Sponsor (“Homepage Entries”). A maximum of three (3) Homepage Entries may be earned per Day;
(ii) a member receives five (5) additional entries every time he or she refers an Internet user to the Website and that Internet user registers with the Website for the first time (“Referral Entries”). Referral Entries will only be considered valid when the member’s referred Internet user registers with the Website via that member’s unique referral link provided in the “Refer a Friend” section of the Website;
(iii) a member may receive additional entries by filling out specified surveys on the Website or by completing certain offers or activities (collectively, “Activity Entries”), as designated by the Website. The Sponsor encourages members to visit the Website frequently to find which Activity Entries, if any, offer additional entries. Only those Activity Entries specified by the Website as offering additional entries, will offer the designated number of additional entries;
(iv) a member receives one (1) additional entry each time he or she performs a search via the search box designated by Sponsor (“Search Entries”). Members may earn a maximum of five (5) Search Entries per Day. Members are not required to click-through on the resulting keyword advertisements in order to earn Search Entries, and members will not earn any additional entries for clicking through on such keyword advertisements;
(v) a member receives ten (10) additional entries for visiting the Website on his or her date of birth and signing in for that Day’s Sweepstakes (“Birthday Entries”). Birthday Entries will be credited to members on their date of birth. For the avoidance of doubt, Sponsor shall consider each member’s date of birth to be the date of birth provided, if any, by each member upon registering with the Website;
(vi) a member may receive ten (10) additional entries for writing a “blog” about the existence of the Sweepstakes and/or Website, and by providing Sponsor with a link to such “blog” as proof of existence of such “blog” (“Blog Entries”). Members should send evidence of their “blogs” to Support@GiveawayADay.com; and;
(vii) in the event a member operates his or her own website(s), such member shall receive ten (10) additional entries for providing a “link” to the Website via such website(s), and by providing Sponsor with proof of such “link” (“Link Entries”). Members should send evidence of their “links” to Support@GiveawayADay.com.
Any
Homepage Entries, Referral Entries, Activity Entries, Banner
Advertisement Entries, Blog Entries and/or Link Entries
earned during this Promotion Period will be credited to
members on the Day of the Grand Prize (as defined below)
giveaway, which will be determined by Sponsor, in its sole
and absolute discretion.
PRIZES: One (1) prize will be
awarded for each daily Sweepstakes giveaway (a “Daily
Prize”). A total of twenty eight (28) Daily
Prizes, including one grand prize (the “Grand
Prize”) as specified by Sponsor, will be
awarded during the Promotion Period with a prize
awarded each day. The prizes offered include: (1)
$75 Best Buy Gift Card with an approximate retail
package value ("ARV") of $75.00 (the
Grand Prize); (12) Fandango $20 Gift Certificates
each with an ARV of $20; (4) Best Buy $25 Gift
Cards each with an ARV of $25.00; (4) Target $25
Gift Cards each with an ARV of $25.00; (4) Walmart
$25 Gift Cards each with an ARV of $25.00; and
(3) Amazon.com $25 Gift Cards each with an ARV
of $25.00. The total approximate retail value of
the prizes offered during this Promotion Period
is $690.00. The odds of winning will be determined
by the number of eligible entries received. The
prizes are subject to availability, and other restrictions,
including federal, state, and local laws as well
as any limitations that may apply. The prize is
non-transferable and we do not allow substitutions
or cash credits. Notwithstanding the foregoing,
the Sponsor may, in its sole and absolute discretion,
elect to substitute prizes of similar value should
the aforementioned prize be unavailable, out of
stock, or not offered in Canada.
DRAWING AND NOTIFICATION: The
Daily Prize winner will be selected, from among
all eligible entries received, in a random drawing
conducted on or about midnight, on each day during
the Promotion Period by the Sweepstakes Administrator,
an independent judging organization, whose decisions
are final in all matters relating to this Sweepstakes.
The odds of winning will depend on the total number
of eligible entries received. Prize winners will
initially be notified via email, then subsequently
via telephone and ultimately confirmed in writing
via USPS mail, or other home delivery service of
the Sponsor’s choice. If a potential winner
i) cannot be reached after a reasonable effort
has been exerted; (ii) is found to be ineligible;
(iii) cannot or does not comply with these Official
Rules; or (iv) prize notification is returned as
undeliverable, that potential winner will be disqualified
and an alternate potential winner may be selected
at Sponsor's sole discretion.
PRIZE CONDITIONS: The winners
are solely responsible for all applicable federal,
state, and local taxes associated with receipt
of a Daily Prize. Winners will be validated to
verify eligibility and compliance with these Official
Rules. This means that each winner of a Daily Prize
will be required to complete and sign an electronic
Affidavit of Eligibility and Liability/Publicity
Release (collectively, the “Affidavit”),
which must be completed and submitted to the Sponsor
within fourteen (14) days of written notification,
or such Daily Prize may be forfeited and an alternate
winner selected, at Sponsor's sole discretion.
In the event a Daily Prize is valued at more than
$599 US Dollars, the winner must include on the
Affidavit his or her Social Security Number or
Resident Alien Identification Number, or both,
if applicable. Winners that do not comply with
the prize conditions set forth herein will become
ineligible and will be consequently disqualified.
Each winner’s entry into these Sweepstakes
constitutes permission (except where prohibited)
for the Sponsor to use said winner’s name
and address (city and state), in all forms of media,
in perpetuity, without notice or further compensation.
Further, each winner’s acceptance of a Daily
Prize offered constitutes permission (except where
prohibited) for the Sponsor to use said winner’s
name, photograph, likeness, statements, biographical
information, voice and address (city and state),
in all forms of media, in perpetuity, without notice
or further compensation. In the event of a dispute
with respect to the identity of an entrant, any
entries submitted online will be determined to
have been made by the Authorized Account Holder
of the e-mail address submitted at time of entry.
For purposes of these Official Rules, an Authorized
Account Holder means the natural person who is
assigned to an e-mail address by an Internet access
provider, online service provider or other organization
(e.g. business, educational institution, etc.)
that is responsible for assigning e-mail addresses
for the domain associated with the submitted e-mail
address. Each potential winner may be required
to provide Sponsor with proof that he/she is the
authorized account holder of the e-mail address
associated with the winning entry.
TERMS AND CONDITIONS: This Sweepstakes
is void where prohibited and/or restricted. This
Sweepstakes is subject to all applicable federal,
state, and local laws. By participating, all entrants
agree to be bound by these Official Rules and the
decisions of the Sweepstakes Administrator, and
waive any right to claim ambiguity in the Sweepstakes
or these Official Rules. In addition, all entrants
also agree to release, discharge, indemnify and
hold harmless the Sponsor, vendors associated with
the Sweepstakes, and the respective officers and
employees of these entities, from and against any
claims, damages or liability due to any injuries,
damages or losses to any person (including death)
or property of any kind resulting in whole or in
any part, directly or indirectly, from acceptance,
possession, use or misuse of any prize offered
by, or participation in the Sweepstakes. For purposes
of these Official Rules, sponsors and vendors include
but are not limited to affiliated companies, information
providers, content providers, subsidiaries, advertisers,
advertising agencies, promotional and marketing
agencies, and any other companies involved with
or otherwise providing services related to the
Sweepstakes. Additionally, for purposes of these
Official Rules, damages include but are not limited
to those that cause harm stemming from the failure
of any electronic equipment, computer transmission
and/or network connections, inaccuracies in information
which may be used with respect to the Sweepstakes,
or any technical or human error which may occur
in the processing or submission of data entry or
entries by contestants.
DISCLAIMER: WHILE WE STRIVE TO
OFFER A VALUABLE SERVICE, THE WEBSITE AND THE SWEEPSTAKES
ARE PROVIDED TO INTERNET USERS ON AN “AS
IS” BASIS AND WITHOUT WARRANTY OR GUARANTEE
OF AVAILABILITY. THEREFORE, THE SPONSOR, ITS AFFILIATED
COMPANIES, PARTICIPATING SPONSORS, INFORMATION
PROVIDERS, CONTENT PROVIDERS, SUBSIDIARIES, ADVERTISERS,
ADVERTISING AGENCIES, PROMOTIONAL AND MARKETING
AGENCIES, AND ANY OTHER COMPANIES INVOLVED WITH
OR OTHERWISE PROVIDING SERVICES RELATED TO THE
SWEEPSTAKES, RESERVE THE RIGHT TO DISCONTINUE THE
SWEEPSTAKES AT ANY TIME, IN WHICH EVENT, ONLY ENTRIES
RECEIVED PRIOR TO THAT DATE WILL BE CONSIDERED.
SPECIFICALLY, IN THE EVENT ANY PORTION OF THE SWEEPSTAKES
IS COMPROMISED BY VIRUS, BUGS, HACKERS, NON-AUTHORIZED
HUMAN INTERVENTION OR OTHER CAUSES BEYOND THE CONTROL
OF THE SPONSOR, ITS AFFILIATED COMPANIES, PARTICIPATING
SPONSORS, INFORMATION PROVIDERS, CONTENT PROVIDERS,
SUBSIDIARIES, ADVERTISERS, ADVERTISING AGENCIES,
PROMOTIONAL AND MARKETING AGENCIES, AND ANY OTHER
COMPANIES INVOLVED WITH OR OTHERWISE PROVIDING
SERVICES RELATED TO THE SWEEPSTAKES WHICH, IN THE
SOLE OPINION OF THE SPONSOR, CORRUPTS, OR IMPAIRS
THE ADMINISTRATION, SECURITY, FAIRNESS, OR PROPER
PLAY OF THE SWEEPSTAKES, THE SPONSOR RESERVES THE
RIGHT, AT ITS SOLE DISCRETION, TO SUSPEND OR TERMINATE
THE SWEEPSTAKES.
MISCELLANEOUS: Any person attempting
to defraud or in any way tamper with the Sweepstakes’ mechanics
and/or implementation will be prosecuted to the
fullest extent of the law and will be disqualified
from participation in the Sweepstakes. As a result
of your participation in the Sweepstakes and the
submission of your contact information via the
Website, you may receive occasional promotional
email, mailings, and/or telephone solicitations
from the Sponsor, its affiliated companies, information
providers, content providers, subsidiaries, advertisers,
advertising agencies, promotional and marketing
agencies, and/or any other companies involved with
or otherwise providing services related to the
Sweepstakes. In the event you remove your information
or any portion thereof from the Website’s
database, your Sweepstakes’ entry or entries
will be immediately removed and your participation
in the Sweepstakes will be discontinued. By using
the Website and participating in the Sweepstakes,
you acknowledge and agree that you are bound by
the terms and conditions contained in these Official
Rules. These Official Rules may be changed, modified
or revised at any time without notification to
you except that they shall be posted on the Website
for you to review. Your continued participation
in the Sweepstakes after any such changes, modification
or revisions shall be deemed an assent to such
changes, modification or revisions. We encourage
you to periodically check these Official Rules
on the Website. If at any time you disagree with
these Official Rules, or any portion thereof, your
only recourse is to remove your name and contact
information from the Website’s database.

These Official Rules shall be governed by and construed
in accordance with the substantive laws of the
State of Minnesota and jurisdiction and venue of
all matters relating to these Official Rules shall
be vested exclusively in the State of Minnesota
and you agree to the jurisdiction of such courts.
No waiver, modification or addition to these Official
Rules shall be valid. The invalidity or unenforceability
in whole or in part of any portion of these Official
Rules will not affect the validity or enforceability
of the remaining portions of these Official Rules.
If for any reason, any provision of these Official
Rules is determined to be invalid or in conflict
with any existing, or future law or regulation
by any court or governmental authority having valid
jurisdiction, such provision shall be modified
to the least extent necessary to become valid or
in conformity with such law or regulation. These
Official Rules constitutes the entire agreement
between you and the Sponsor relating to your participation
in the Sweepstakes. Nothing in these Official Rules,
express or implied, is intended or shall be construed
to create any third-party beneficiaries. Neither
these Official Rules nor any of the rights, interests
or obligations hereunder may be assigned by you.
SWEEPSTAKES PRIVACY POLICY: Your
privacy is important to us. We collect and store
your contact information to determine eligibility
for your participation in the Sweepstakes and to
contact the winners and deliver prizes won as well
as send occasional promotional material. Your information
may be shared with or sold to partners of the Sponsor
or unrelated third-parties at any time or for any
reason, in the Sponsor’s sole discretion.
You may also receive promotional materials including
emails from the Sponsor or related third-parties.
You may opt-out of receiving emails from the Sponsor
by following the instructions provided on the Website’s
Privacy Policy.
WINNERS LIST: To request confirmation of the names of the winners of a Daily Prize, please send a self-addressed, stamped business size envelope, by May
20, 2008,
